NT Supreme Court Finds Medical Board Decision Unlawful<\/strong><\/p>\n

The Supreme Court of the Northern Territory has found that there was no evidence<\/strong> for the Medical Board of South Australia and the Medical Tribunal of the Northern Territory to argue that Dr Nitschke posed \u2018a serious risk to persons\u2019 for which it was\u00a0 \u2018necessary to take immediate action to protect public health or safety\u2019.<\/p>\n

As such the Tribunal\u2019s decision was unlawful.<\/strong><\/p>\n

Secondly<\/strong>, the judgment states that as a result of this lack of evidence<\/strong>, the Tribunal misconstrued the Code of Practice.<\/p>\n

Thirdly<\/strong>, the Supreme Court found that the Tribunal denied procedural justice to Dr Nitschke in that it failed to give him \u2018adequate opportunity to respond\u2019.<\/strong><\/p>\n

The folder revealing extensive academic literature on rational suicide which attempted to be tendered by Dr Nitschke\u2019s barrister, the late Mr Peter Nugent \u2013 himself suffering from Stage 4 Bowel Cancer \u2013 was refused by the Tribunal.<\/p>\n

Speaking from London where is he is preparing his Edinburgh comedy debut \u2013 \u2018Dicing with Dr Death\u2019<\/a> \u2013 Dr Nitschke said it was \u2018a good day for the rule of law in Australia. The law and common sense have prevailed\u2019.<\/p>\n

\u2018To date, the suspension of my medical registration has been characterized by politics and innuendo<\/strong>.\u00a0 Opponents of voluntary euthanasia have attempted to cause harm to my reputation and to damage the movement\u2019 he said.<\/p>\n

\u2018Today, the Court has tossed out the Medical Board\u2019s political persecution of me\u2019.<\/p>\n

\u2018Given today\u2019s judgment I have no faith in the bodies that are supposed to govern the medical profession<\/strong> and will now be considering my position for the next 12 complaints the Medical Board are seeking to bring against me.\u2019<\/p>\n

Dr Nitschke has no immediate plans to pay his medical registration fees<\/strong> as he said he has \u2018no need to be a registered doctor in order to be a comedian or run his pro-voluntary euthanasia organization Exit International\u2019.<\/p>\n
