After marathon debates in both Houses of Parliament, the Victorian Parliament has revived euthanasia in Australia by passing the first right to die law since the Northern Territory’s Rights of the Terminally Ill Act<\/a><\/strong> <\/em>21 years ago.<\/p>\n

In 1996, Exit Founder & Director Dr Philip Nitschke administered the world’s first legal, lethal voluntary injection to terminally ill man, Bob Dent.<\/p>\n

The NT law lasted just 9 months before a conscience vote in the Australian Federal Parliament – sponsored by deeply conservative\/ catholic Melbourne MP Kevin Andrews – overturned the law.<\/p>\n

Section 122 of the Australian Constitution<\/a><\/strong> allows the Australian Parliament to make laws for the Territories. In the case of the Rights of the Terminally Ill Act<\/em>, the Euthanasia Laws Act<\/em> was able to state euthanasia as an issue on which the Northern Territory could not make a law.<\/p>\n

In 2017 in Victoria, S122 does not, and never will, apply because Victoria is a State, not a Territory.<\/p>\n

Titled the ‘Voluntary Assisted Dying’ Act<\/a>,<\/em><\/strong> the new Victorian allows enlists doctors to allow a terminally ill person to die. The law will be enacted in mid 2019.<\/p>\n
