{"id":7669,"date":"2020-10-08T20:44:44","date_gmt":"2020-10-08T12:14:44","guid":{"rendered":"https:\/\/exitinternational.net\/?p=7669"},"modified":"2020-10-08T20:44:45","modified_gmt":"2020-10-08T12:14:45","slug":"ireland-dying-with-dignity-bill-moves-to-committee-stage-after-vote","status":"publish","type":"post","link":"https:\/\/www.euthanasia.net\/exit\/ireland-dying-with-dignity-bill-moves-to-committee-stage-after-vote\/","title":{"rendered":"IRELAND: Dying with Dignity Bill Moves to Committee Stage after Vote"},"content":{"rendered":"<p>TDs have voted down a Government proposal to refer the Dying with Dignity Bill to a special Oireachtas committee to consider the legislation and report back within 12 months by 86 to 65 votes.<\/p>\n<p>Instead, the legislation sponsored by People Before Profit will now progress to the committee stage.<\/p>\n<p>All TDs in the three Government parties with the exception of Cabinet Ministers were allowed a free vote on the Government counter-motion. But once it was defeated, Ministers were also allowed a free vote on the legislation itself.<\/p>\n<p>In a second vote, the D\u00e1il backed the progress of the legislation by 81 to 71 votes.<\/p>\n<p>All 33 Fine Gael TDs supported the Government amendment. Fianna F\u00e1il split, with 24 votes in favour of the special committee , 12 against and one abstention. Eight Green Party TDs were in favour of the special committee and four against.<\/p>\n<p>Sinn F\u00e9in, the Labour Party and the Social Democrats opposed the deferral of the Bill. All but two Independents opposed the deferral but a number of Independents also opposed the progression of the legislation.<\/p>\n<p>The Bill provides for people with progressive terminal illness to decide the timing of their own death and avail of assistance to end their lives under controlled and monitored circumstances.<\/p>\n<p>Their illness has to be verified by two doctors, to be able to avail of assistance to end their lives, an act that currently carries a 14-year prison sentence.<\/p>\n<p><strong>People Before Profit<\/strong> TD Gino Kenny, who introduced the Bill, was seeking support for the legislation to proceed to committee stage.<\/p>\n<p>However, Minister for Justice Helen McEntee introduced a counter-motion to establish a special Oireachtas committee that would consider all the legislation and report back in 12 months.<\/p>\n<p>Mr Kenny said during debate on the legislation last week that it would be regrettable if the Bill was delayed a further 12 months. He acknowledged that the issue was extremely difficult for everyone.<\/p>\n<p>But he said the most important voice should be that of the person in an irredeemable situation where they are facing unbearable pain in their terminal illness.<\/p>\n<p>\u201cThey should have that choice. We should hear their voice and not vilify them,\u201d he said.<\/p>\n<p>The Government amendment refers to \u201cassisted suicide\u201d but the Dublin West TD said it was irresponsible to conflate assisted dying with suicide, which had very different connotations.<\/p>\n<p>He said the Bill does not allow for assisted dying in cases where the person looking for help does not suffer from a terminal illness. \u201cPeople suffering from depression or other mental health issues could not access this law. People suffering from non-life-threatening physical illness could not avail of assisted dying. People of advanced age could not avail of this law.\u201d<\/p>\n<p>The Minister for Justice in recommending a special committee, said there are medical, ethical and moral considerations. These were complex issues of the most fundamental importance, she added.<\/p>\n<p>Ms McEntee said the committee would have to look at safeguards \u201cneeded to ensure that a person is not subjected to any pressure by any third parties\u201d.<\/p>\n<p>It would also have to look at unintended consequences that might create adverse impacts on vulnerable people.<\/p>\n<p><strong>Legislation<\/strong><\/p>\n<p>If Ireland passes the legislation it would become one of only a few countries or regions to do so including Switzerland, the Netherlands, and the US states of Oregon and Washington.<\/p>\n<p>New Zealanders will vote in a referendum on October 17th on whether to permit assisted dying.<\/p>\n<p>Mr Kenny rejected claims by opponents of the legislation that it will lead to a \u201cslippery slope\u201d where the value of human life is diminished.<\/p>\n<p>At the weekend a bishop described the legislation as assisted suicide and a \u201cfalse exercise of compassion\u201d. Bishop of Cloyne William Crean said tolerance of the practice was \u201cflawed in its moral judgment\u201d.<\/p>\n<p><strong>\u00a0In 2013 Marie Fleming, who had multiple sclerosis, lost her right to die case in the Supreme Court. Ms Fleming died later that year but her partner &#8211; Exit Director Tom Curran &#8211; has continued to campaign for the right to die.
